Filed with the District Court of Zeeland-West-Brabant, Breda location under number 25/2021 and with the Chamber of Commerce under registration number 82940460
Article 1 – Scope
These Terms and Conditions (hereinafter: “Terms”) apply to all offers made by Blow up Extreme B.V. (hereinafter: “Blow up”) to both consumers and business clients, including the purchase of admission tickets, vouchers, and gift cards, as well as any agreement concluded between Blow up and the person purchasing such admission (hereinafter: the “customer”).
These Terms also apply when purchases are made through an authorized ticketing partner.
The term “event” refers to performances, exhibitions, or other activities organized by Blow up in the broadest sense. The “venue” includes the actual event location and all surrounding grounds or spaces designated for the event. The house rules are an integral part of these Terms. The applicability of the customer’s own terms and conditions is explicitly excluded.
Article 2 – Agreement Formation and Ticket Terms
An agreement between the customer and Blow up is formed once a ticket is purchased through Blow up or its official partner. In all other cases, the agreement begins when the visitor enters the event.
Due to the nature of leisure services and the limited validity of tickets, the statutory 14-day reflection period does not apply.
Tickets may consist of a document or barcode (digital or printed). The barcode is unique and grants one-time entry. Tickets remain the property of Blow up. Only the first person to present a valid ticket gains access. Blow up assumes the ticket holder is the rightful customer.
Customers must ensure their ticket remains in their possession. Blow up reserves the right to refuse or cancel any order without explanation. Lost, stolen, or damaged tickets are not the responsibility of Blow up. Only tickets purchased from authorized outlets are valid.
Blow up may set a maximum number of tickets per customer. Only one promo code can be applied per ticket (if applicable). If tickets are purchased from third parties, Blow up is not responsible for customer service or ticket validity.
Article 3 – Ticket Resale Prohibited
Customers may not resell or use tickets for commercial purposes unless explicitly approved. TicketSwap.nl is the only authorized resale platform. Personal transfers for non-commercial use must follow all rules in these Terms. Personalized tickets are non-transferable. Identity checks may occur.
Article 4 – Customer Obligations
Customers must follow all staff instructions. One warning will be issued before removal without refund.
Bag checks and personal searches may be conducted. A valid ticket must be shown at any time upon request.
Identification may be required for legal compliance. Bags and backpacks are not permitted inside the event space and must be stored in provided lockers.
Professional recording equipment is prohibited. Smartphones are allowed for personal use only. Blow up accepts no liability for confiscated items.
Glass, cans, fireworks, weapons, alcohol, drugs, and other prohibited items are not allowed. Entry will be denied if under the influence.
Professional recording or publishing of event content is not allowed and will result in immediate destruction of the material.
If a customer exits the venue, the ticket becomes invalid. Customers must adhere to all house rules, including no smoking except in designated areas.
Blow up recommends a minimum age of 16 for unaccompanied minors and reserves the right to set specific age restrictions per event. All participants must be at least 4 years old.
Article 5 – Blow Up’s Rights
Violation of these Terms may lead to ticket invalidation and denial of entry without refund. Criminal acts will be reported. Repeat violators may be banned for five years and added to an internal incident list.
Threats or abuse toward staff in any form will result in immediate action and possible legal reporting. Customers may be blacklisted from all Blow up events.
If a ticket is suspected to be counterfeit, Blow up may deny entry without compensation.
Blow up and its partners may record the event for promotional use. By attending, customers waive any rights to oppose the use of their likeness.
Additional safety protocols may be introduced and communicated to customers. Live security cameras may operate on-site and footage may be shared with authorities if required.
Article 6 – Force Majeure
In case of force majeure (including illness, strikes, weather, pandemics), Blow up reserves the right to postpone or cancel the event.
If canceled before it starts, customers are entitled to a refund of the ticket value (excluding service fees). If canceled mid-event, only a partial refund may apply.
If rescheduled, tickets remain valid. Customers unable to attend the new date may request a refund within two weeks, provided they present an undamaged ticket. Travel or accommodation costs will not be reimbursed.
Article 7 – Liability
Blow up is only liable for damages covered by its insurance. The following are excluded:
- Personal injury
- Indirect or consequential damages
- Emotional distress
- Damages caused by third-party actions
Participation in events and activities is at the customer’s own risk. Blow up is not liable for property loss or damage, hearing/vision issues, or physical injury.
Blow up is not responsible for program changes, schedule delays, or missed performances. Event start times are subject to change.
Article 8 – Data Protection
Blow up processes personal data according to its Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR). For full details, visit: https://blowupextreme.com/privacy-policy/
Article 9 – Final Provisions
